New salary regulations for highly qualified professionals from outside the EU

The Spanish government has implemented a new regulation
stipulating a minimum annual salary of €36,255 for highly skilled workers hired
from outside the European Union. This strategic move aims to balance the
attraction of global talent with the competitiveness of local enterprises.

Effective
immediately, businesses wishing to sponsor residency for non-EU highly skilled
employees must ensure a salary that not only meets the minimum requirement but
also reflects the value and qualifications of the workers. This policy, which
sets the salary at 1.4 times the average gross salary in Spain, is part of a
broader initiative led by various ministries including Inclusion, Social
Security and Migration; Economy, Trade and Business; Foreign Affairs, European
Union and Cooperation; and the Ministry of the Interior.

Specific Details:
This salary policy is initially applicable for three years, with an extension
option provided the employment conditions are maintained. Moreover, the
community directive allows for salary flexibility for specific professions such
as lawyers, professors, managers, journalists, musicians, and sculptors, where
the threshold may be reduced to 80% of the established figure, ensuring it does
not fall below the average gross salary of €25,896.82.
